1. Introduction

1.1 These terms & conditions set out the terms between you the customer and us the website owner

1.2 Your use of this website and any service contained within constitutes acceptance of these terms & conditions in full.

1.3 You should not use this website if you do not accept with these terms & conditions in full.

2. Customer Information

2.1 You should always check that the contact information you provide is correct before creating a customer account or proceeding to payment.

2.2 You are responsible for maintaining your own username and password, where required to access your customer account. You should ensure that you store your username and password securely and that the details required to access your customer account are not provided to another party.

2.3 As a customer you are responsible for your customer account and actions taken within it. If you are aware or suspect that your customer account username and password or other details have become known to a third party, you should inform us immediately.

2.4 Our website is only intended for use by adults. Adults may purchase products for children as long as the products purchased are intended by the manufacturer for use or consumption by children.

2.5 We reserve the right to restrict or remove your access to this website where you breach these terms and conditions. Such restriction or removal will take place without recourse or explanation to you where we solely deem it appropriate or necessary.

4. Product Pricing and Title

4.1 We make every effort to ensure that the pricing displayed on our website is correct. However, if an error in the pricing of a product is found we will not be liable to supply that item to you at the stated price and we reserve the right to either cancel your order or contact you to arrange payment of any extra sum due or refund any over-payment made by you (as applicable). The processing of an order can be cancelled or corrected by us at anytime up to the shipment of that order and any related items. 

4.2 We reserve the right to alter all product pricing without notice.

4.3 Title in any products ordered from us does not pass to you, the purchaser until we have received and processed a valid payment, and that payment has been made into our own bank account and your order has been shipped.

 

5. Your Order

5.1 When you place an order you will automatically receive a confirmation email from us to confirm your order. Your order constitutes an offer made to us to purchase the goods specified in the order.

5.2 Your offer is only accepted by us once we have emailed you to confirm the dispatch of your order.

5.3 Product items not included within the dispatch email are not included in the order and contract between you and us.

5.4 We reserve the right to delay or refuse orders where a transaction contains incomplete details or details that cannot be verified or where fraud is suspected.

5.5 If we are unable to reasonably ascertain these details or resolve these issues a full refund will be made against the card used at the time of purchase. No other form of refund or credit will be offered nor will a refund be made to any third party card or account.

6. Stock

6.1 Although we have a large amount of stock in our warehouse in the event that we are out of stock of the item you have requested we will contact you advising of you of this and offer you a revised estimated date of delivery

7. Shipping and Customs Duty

7.1 All orders received by us are shipped subject to availability.

7.2 We reserve the right to ship products at a later date (up to 28 days after purchase) where the product ordered is not in stock at the time of purchase. In this situation you will be contacted

7.3 We cannot be held responsible for disruption to shipping caused by industrial disputes or action outside our direct control.

8. Cancellation Rights and Refunds 

8.1  If you are required to sign for your goods by doing so you will be confirming to the courier that they have been delivered in a good condition. We will not provide either a refund or replacement item if you claim that your item is damaged if you have signed for them. PLEASE THEREFORE INSPECT THE GOODS BEFORE SIGNING FOR THEM.

8.2 Under the Consumer Contracts Regulations 2013 you have a right to cancel your purchase. However, to exercise this right you must notify us in writing, either by email or letter within 14 working days from the day after you receive your goods.

8.3 As stated above notification of cancellation must be in writing, a telephone call is not a valid cancellation.

8.4 No right of cancellation, refund or return exists under the Consumer Contracts Regulations 2013 once you have used your product, unless the product is defective and you are returning it for this reason. Therefore if the goods are not returned in an unused and not in a new condition no refund will be provided.

8.5 Goods that are sealed or shrink-wrapped and this is removed can only be returned if they are defective.

8.6 No right of cancellation exists for personalised goods or goods that are intimate in their nature or goods where there may be hygiene issues, unless defective or where they are have been cut to length to the size required by you including but not exhaustive to items such as pipework, liner, underlay air line..

8.7 Please observe the following procedure for all returns to us:

8.7.1 Notify ourselves that you may wish to cancel your purchase in accordance with clause 8.2; and

8.7.2 Once we have acknowledged your notice and have accepted your right to cancel, we will provide you with an address to return your product please note that this is not our registered office address. Please do not return goods to this address. When returning the item please write on the back of your invoice the reason for the return; and

8.7.3 If you are returning your product because it is defective, please state the defect or defects; and

8.7.4 Repackage the product in its original packaging, including any accessories, brochures, manuals, guarantees or warranties that came with the product. Unfortunately we will be unable to issue a refund where the product is in an incomplete state, used or where the original packaging has been damaged and or is not in a resalable condition.

8.8 If the original packaging surrounding the product has been damaged or destroyed we will only issue a refund if the product is being returned due to a defect. If the original packaging of a defective product has been damaged or destroyed you should ensure that the returned product is adequately packed for shipment back to us.

8.9 You are responsible for paying any postage or shipping costs incurred when returning the product.

8.10 We recommend that all returns be sent by registered post, so that a record of the return is available for you.

8.11 We will not issue refunds for any items were the item and or its original packaing has been lost or stolen or damaged in tansit to us. 

8.12 Where a return is lost or stolen or damaged in transit to us, you should claim compensation from the company that shipped the return.

8.13 Unused products may be returned promptly by customers to our address listed at the end of these terms and conditions.

8.14 Subject to the above conditions being satisfied, we will at our discretion refund the purchase price of a returned product less the cost of the original carriage within thirty days of receiving written notification of your intention to cancel your order and return the product. In the event that postage and packing was free then the cost of the delivery incurred by ourselves in send the original will be deducted from the cost of the product which you have returned.

9. Warranties and returns

9.1 We will endeavour to honour the manufacturer’s warranty on all goods purchased from us provided they have been properly maintained and looked after in accordance with the terms of the manufactures guarantee

9.2 Before returning any goods to ourselves please contact ourselves in writing by either by letter or email providing details of the fault, in the first instance we will try and resolve the fault over the telephone.

9.3 Once we have confirmed that the goods can be returned please return these to ourselves, an address to return the goods will be provided as this address is different to our registered address. Please do not return any items to our registered address. The cost of returning the goods is your responsibility and we would also ask that you return the goods along with the original proof of purchase for us to repair, if possible or replace it if this is not repairable. We can not accept any returns without proof of purchase. The only proof of purchase we will accept is a copy of your invoice from us.

9.4 Provided our terms and conditions have been complied with we will at our discretion replace any item. We will not replace any items which are not covered under the manufactures guarantee such as parts which are subject to wear and tear such as light tubes, quartz sleeves Impellers, diaphragms etc or where there has been a breach of the manufacturers guarantee. For further details please refer to the manufactures terms of warranty

9.5 We recommend that all returns be sent by registered post, so that a record of the return is available for you.

9.6 We will not issue refunds for any items were the item and or its original packaing has been lost or stolen or damaged in tansit to us. 

9.7 Where a return is lost or stolen or damaged in transit to us, you should claim compensation from the company that shipped the return

9.8 If the unit is returned to ourselves and found not to be faulty then you will be responsible for paying for the cost of returning the unit to ourselves as no refund and or replacement will be provided by us in the event that the goods are not faulty.

10. Delivery

10.1 All orders received by us are shipped subject to availability and any timed deliveries i.e. next day are only an indication of when your goods should arrive.

10.2 We reserve the right to ship products at a later date (up to 28 days after purchase) where the product ordered is not in stock at the time of purchase. In this situation you will be contacted

10.3 We cannot be held responsible for disruption to shipping caused by industrial disputes or action outside our direct control.

10.4. Our website provides details of the cost of our delivery at the checkout stage. The cost of delivery is calculated on the basis of the total weight and cost of your order. For all orders over £50.00 we will not make a charge for standard delivery provided that delivery is not to the Highlands, Islands, Northern Ireland, Republic of Ireland, Isle of Scilly, Isle of Man, jersey and Guernsey or to a country outside the UK or a destination that the courier company that we use deems to be remote. For all orders over £50.00 to these areas a discounted delivery charge will apply.

10.5. If you have not selected our premier express delivery or Saturday delivery service you will receive your goods via standard delivery. We aim to have all accepted UK orders placed before 12pm despatched within three (3- 5) working days, although this time may be extended if your order is placed close to a UK bank or public holiday.

10.6. We offer a Saturday delivery for an additional fee details of our charges are provided when you check out. Please note that Saturday delivery are only available if your order is placed before 12pm on the proceeding Thursday and we have your order in stock.

10.7. If you have chosen our premier express delivery option the following conditions will apply:-

10.7.1 If you select our express delivery option, and your UK order is placed and accepted before 12pm Monday, Tuesday and Thursday, we aim to have your order delivered to your door the very next day provided the next day is not a UK bank or public holiday.  

10.7.2 If your order is received after 12pm your order will usually be dispatched the next working day

10.7.3 Us having in stock the products you ordered, if this is not the case we will advise you of this.

10.7.4 Express delivery is not available for certain areas of the UK including the Highlands and the Channel Islands. For a full list of available postcodes please contact customer services if the delivery destination is located in an area where our express delivery is not available, your order will be delivered as soon as possible

10.8. Free delivery offers, when available, only apply to UK Mainland. Free delivery offers are sent using Standard delivery service, please see "UK Delivery option: Standard delivery". Free delivery offers cannot be used in conjunction with any other offer, promotion or discount code 

10.9 Many of the orders which are dispatched will require your signature therefore please ensure that you are in attendance at the address when your item is delivered. In the event that you are not and the item has been sent by Yodel then a card will be left at the shipping address providing instructions to you. The courier may in any event attempt to deliver the item to you next working day. 

10.10. If you are required to sign for your delivery and do so this will be an indication that you are satisfied with the condition of your goods. Please therefore ensure that you inspect the goods before signing. In the unlikely event that your order has been damaged please do not accept delivery of your item and notify us immediately and subject to us receiving the damaged goods back we will at our own discretion dispatch your goods again. If you have signed for your goods and they are damaged we may have to arrange to collect them from you we will provide you further information if required.

10.11 If we have proof of delivery provided by our courier such as proof of delivery by means of a signature obtained at the time of delivery by our courier whether this signature is yours or a third party or a person purporting to be you we will deem this as evidence that the goods have been delivered  and received by you and we will not accept any liability for any loss

10.12. In the unlikely event that your order is damaged in transit then you must notify us of the damage within 48 hours of you recieving the goods, we will not be able to send out any replacement if you advise us later than 48 hours after delivery of your order. In the event that we agree to send out a replacement goods –  we will before agreeing to this require photographs of both the damaged goods and the inside and outside packaging together with any other information our courier may require. Please therefore retain all packaging until such time we confirm to you that a replacement will be sent. In addition to this in the event that we may need to make a claim against our courier for damage to your parcel you agree to us disclosing to the courier your name address and contact details as required.

10.13. If we require the damaged item to be returned we will not be able to resend a replacement until the damaged goods are in our possession.

10.14 If a card is left by our courier and you fail to collect your goods in accordance with the terms provided by them courier and as a result of your failure to collect the goods are returned to ourselves we will offer to resend it to you. There will be an additional charge for reposting the item together with a further £2.50 administration charge for processing the redelivery you will be responsible for paying both the additional charge and the further £2.50 before the goods are resent. If the goods had originally been delivered to you free of charge we will charge you for redelivering the item to you in addition to the £2.50 administration fee. Your order will not be dispatched without cleared payment having been received from you to ourselves.

10.15. If your item is dispatched using Royal Mail postage and no tracking information is available in the event that your order is lost then as a company we will need to submit a claim for the loss of these items with Royal Mail. Royal Mail will not permit a claim to be submitted until 15 working days has elapsed from the date of dispatch of the item that has gone missing as they are of the opinion that an item may still be delivered during this time and therefore cannot be deemed as being lost. Therefore in the event that your order has not arrived if sent by Royal Mail post we will not be able to either refund  you your order or dispatch a replacement until the 15 days has elapsed.

10.16 We shall not be liable for delay or failure to deliver your order and if in the event that your order does not arrive please notify us within 14 days of placing your order. We are not able to provide a refund or replacement were notification of the loss is over 14 days.

10.17 We reserve the right not to deliver to PO Box addresses or to a forward mailing services such as Empresa mail in the event we make this decision we reserve the right to cancel your order

10.18 Regardless of what courier we use to deliver your order we would ask that upon receipt of your order that you check the content immediately and in the very unlikely event that their are any errors with your order or your order has been damaged during transit then please contact us either by email or telephone to notify us of problem immediatly. If you fail to do so within 48 hours of you receiving your order and or you fail to answer any questions we may raise within a reasonable time then we will not be able proceed with any claim for the discrepancies and or damages in your order.

 

11. Events Outside Our Control

11.1 We shall not be liable for delay or failure to perform any obligation under these Terms & Conditions if the delay or failure is caused by any circumstances beyond our reasonable control, including, but not limited to, acts of god, war, civil disorder or industrial dispute.

12. Licence

12.1 We grant you a licence to access the content, information and services contained within our website for personal use only.

12.2 This licence allows you to download and cache (using your browser) individual pages from our website.

12.3 This licence does not allow you to download and modify individual pages or substantial parts of our website nor to make our website available via an intranet, where our website or a substantial part of it is hosted locally on the intranet in question.

12.4 Our website design, layout, content or text cannot be copied, edited or otherwise manipulated without our express prior written permission.

12.5 Our website cannot be placed within the frame-set of another site.

12.6 Third parties are not allowed to “deep link” to pages within our website, without our express prior written permission. All links (unless expressly permitted by us) should be to the main index page of our website. Furthermore, the content of such links, whether graphic or text should not be misleading, false, derogatory or in any other way offensive.

12.7 The restriction on “deep linking” does not apply to affiliate partners who wish to send customers directly to a particular page or product in order to increase their affiliate sales.

13. Copyright

13.1 All content, databases, graphics, buttons, icons, logos, layouts and look & feel are our copyright, unless expressly acknowledged as otherwise.

13.2 The data mining, extraction or utilisation of product information from our website is not permitted without our express prior written permission.

14. User Generated Content and links to other sites

14.1 Where the facility exists you may provide reviews or public feedback on the website of products purchased by you, also known as user-generated content.

14.2 Where the facility exists such user-generated content can be provided in different formats and mediums; text, audio, video and still photographs.

14.3 As part of providing this content to us you agree to grant us a worldwide, irrevocable, non-exclusive and royalty-free license to use, distribute, edit, translate and repurpose such content, as we require, including sub-licensing to other parties.

14.4 Such content shall not infringe the intellectual property rights of any other party. Furthermore the content shall not be illegal or capable of breaching the laws of any jurisdiction in which it may be displayed.

14.5 We reserve the right to remove any content, which breaches or risks breaching these terms and conditions.

14.6 However, we shall not assume any responsibility for auditing or monitoring any user generated content.

14.7 Any links to third party websites located on this Website are provided for your convenience only. We have not reviewed each third party website and have no responsibility for such third party websites or their content. We do not endorse the third party websites or make representations about them or any material contained in them. If you choose to access a third party website linked to from this Website, it is at your own risk.

14.8 If you would like to link to this Website, you may only do so on the basis that you link to, but do not replicate, any page on this Website, and subject to the following conditions: 

14.8.1 you do not in any way imply that we are endorsing any services or products unless this has been specifically agreed with us;

19.1 Our Price Promse means we will match our competitiors advertised on line uk price the following conditions apply .

19.1.1 The product subject to our Price Promise must be advertised on line by our competitor 

19.1.2 The competitor’s product must be brand new, identical to ours, and offered on the same terms and have a similiar shelf life they perishable goods such as food or treatments.

19.1.3  We and the competitor must have the product subjec to our Price Promise in stock and ready for immediate delivery.

19.1.4  We must be able to verify the competitor’s price and stock position.

19.1.5  We’ll match the price of a product; not delivery charges or other services.

19.1.6  Our Price Promise can not be used with any other offer.

19.1.7  Price Promise excludes items sold through auction websites or private sellers.

19.1.8  Price Promise is product specific and excludes overarching or store wide promotions, offers and discounts by any Selected Retailer. We will not Price Match our competitor store where their price is part of a multiple discount.

19.1.9  Our Price Promise is for personal use only. We reserve the right to restrict our Price Promise on each item to one per customer

19.1.10 Our Price Promise will not apply if the relevant competitior is in administration or closing down

20. Variation

20.1 We reserve the right to vary these terms & conditions at any time, without giving notice to you. Such varied terms and conditions shall automatically apply to the use of our website from the date of publication on our website.

21. Assignment

21.1 We reserve the right to assign our rights and also our obligations under these terms and conditions, without giving notice to you. This right of assignment shall only apply to us and shall not apply to you in any way.
